Per- and polyfluoroalkyl substances, which are known as PFAS or “forever chemicals” and can be found in many consumer items, don’t degrade easily. They have been discovered in about 45% of the country’s supplies of drinking water. In the past, PFAS has been linked to medical problems. However, in 2025, the Keck School of Medicine at USC published a comprehensive and alarming ecological study that determined communities exposed to PFAS-contaminated drinking water also have a 33% higher incidence of testicular cancer, kidney cancer, liver cancer, thyroid disease, thyroid cancer, and ulcerative colitis. Two datasets were used for the Keck study: all cancer cases reported from 2016-2021 and data on PFAS present in drinking water that was from the EPA’s Unregulated Contaminated Monitoring Program. PFAS-contaminated drinking water is estimated to be part of 6800 cancer cases every year. In order to establish your case, we will need to make sure you have one of the injuries that has a known significant connection to PFAS, and we will also need to prove that you were exposed to PFAS in your drinking water.
Types of Cancer That Allow Us to Bring a LawsuitIt’s important when bringing a toxic tort lawsuit to have science on your side. This means that links between certain types of cancers and PFAS-contaminated drinking water can make it more straightforward to establish your case. Kidney cancer and testicular cancer are two injuries that qualify for purposes of us bringing a lawsuit on your behalf. However, these cancers must have first been diagnosed by a doctor after January 1, 2005. Other qualifying injuries are ulcerative colitis, liver cancer, thyroid cancer, and thyroid disease, including hyperthyroidism, hypothyroidism, thyroiditis, Hashimoto’s disease and Grave’s disease.
Types of Exposures that Our Attorneys Consider When Deciding Whether There’s a ClaimAdditionally, our Chicago-based lawyers will need to be able to allege on your behalf that you were exposed in certain ways to PFAS. This establishes the possibility of a causal link between your injury (one of the above cancers) and PFAS-contaminated water. There are a few alternatives. One alternative is that we’ll need to allege you lived for a minimum of 6 months from 1975 to the present at one or more homes that were serviced by a water district that is known to have found PFOA or PFOS in the water. Another alternative is that you lived for a minimum of 6 months from 1975 to the present at one or more homes serviced by a private water well and there is a reason to believe that the water in the well was contaminated by PFAS. There are several ways to establish that a private well was contaminated, including water test results showing PFOS or PFOA, location within close proximity to a water district that has known contamination, location within close proximity to a Part 129 Airport or United States military base. Still another alternative is that you worked or lived at a U.S. military base. Sometimes drinking water is contaminated by AFFF (firefighting foam), and so those who worked for at least 6 months as a firefighter between 1975-2016 and were exposed to AFFF, are also eligible. You can also qualify to bring a claim if you worked for a minimum of 6 months at a facility where AFFF was stored, used, or produced.
There are some circumstances whereby a Chicago or other U.S. resident passes away and we are able to bring a claim using the foregoing criteria.
